RODO INFORMATION CLAUSE TO MEET CONTACT PERSONS FROM CUSTOMERS / COUNTERPARTIES IN CONNECTION WITH THE CLOSING OF COOPERATION WITH THE CUSTOMER / COUNTERPARTY IN THE CASE OF OBTAINING DATA FROM SUCH PERSON

  1. The administrator of your personal data is H2 DYSTRYBUCJA Sp. z o.o. with its registered office in Warsaw, ul. Annopol 4A, (hereinafter referred to as “the Administrator”). The Administrator can be contacted by e-mail address: b2b@hdwa.pl, tel. (22) 751-40-44
  2. Your personal data will be processed in order to implement cooperation with the entity on whose behalf you act. Your personal data will also be processed for the purpose of sending information about industry events organized by the Administrator, as well as for analytical and statistical needs related to their sending.
  3. The legal basis for the processing of your personal data is the legitimate interest of the Administrator, consisting in providing contacts necessary for the implementation of business activities, including cooperation with the client / contractor, as well as informing you about industry events organized by the Administrator (art. 6 ust. 1 lit. f RODO).
  4. Access to your personal data will be provided by employees of the Administrator, subcontractors and entities providing services to the Administrator (i.e. IT services and technical support), who must have access to data to perform their duties.
  5. Your personal data will be stored for the period necessary to implement and settle this cooperation, which may, if appropriate, be extended by the period of limitation of civil law claims.
  6. You have the right to:
    1. request access to your personal data, rectification, deletion or limitation of processing, as well as the right to transfer data,
    2. objecting to the processing of your personal data at any time, for reasons related to your particular situation,
    3. lodging a complaint to the supervisory body, i.e. the President of the Office for Personal Data Protection.
  7. Providing data is voluntary, however, failure to provide them will result in the inability to cooperate with the entity on behalf of which you act.
  8. Your personal data will not be used to make automated decisions, including profiling.

B2B Regulation And definitions

  1. The terms used in the regulations mean:
  2. H2 – H2 Dystrybucja Sp. z o.o. with its registered office in Warsaw (03-236) at 4A Annopol Street, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register under the number KRS: 0000795380, tax identification number 5242888138, REGON 383919404, capital share capital PLN 10,000. Paid in full.
    b. hdwa.pl – website run by H2 Dystrybucja Sp. z o. o. enabling customers to purchase products on the terms set out in the Regulations.
    c. User – an entity that meets the conditions set out in the Regulations, has registered, as a result of which an account was created for it, and gained access to the services provided by H2 Dystrybucja Sp. z o. o . as part of the hdwa.pl website . d. Regulations – these Regulations of hdwa.pl
    e. Account – maintained by H2 Dystrybucja Sp. z o. o. on the hdwa.pl website an account enabling the User to use the hdwa.pl website using the Login and Password
    f. Login – a string of alphanumeric characters or an email address necessary to access the User’s account.
    g. Newsletter – electronic information about the offers of products sent to users 
    h. Registration – a one-time activity of creating an account by the User, made on the hdwa.pl website in accordance with the procedure of setting up an account 
    i. Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended)
    j. Sales contract – a sales contract for products, within the meaning of the Civil Code, concluded between H2 Distribution and the customer using the hdwa.pl website

II. General provisions

 

  1. These regulations set out the rules for sharing the hdwa.pl platform for selling products using means of distance communication and for users to use the hdwa.pl website available at www.hdwa.pl and the services offered through it.
  2. In the scope of services provided electronically, these regulations are the regulations referred to in art. 8 of the Act of July 18, 2002. on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended)
  3.  Exclusive rights to the content made available on the hdwa.pl website, including text, graphic, audio and page layout elements, are subject to legal protection, in particular the provisions of the Act of 4 July 1994 on copyright and related rights, and H2 Distribution or entities from which H2 Distribution has concluded relevant agreements with.
  4. The user is obliged to comply with these regulations

  6. H2 Distribution provides the following services through Hdwa.pl;
    a. Enabling customers to conclude Contracts for the Sale of Products at a Distance
    b. Providing Customers with information about the Products available at Hdwa.pl
    c) informing customers about Products about H2 Distribution Services via Newsletter sent via email 
  7. Hdwa.pl users can be legal persons or organizational units without legal personality as well as natural persons conducting business activity.
  8. Using the Hdwa.pl website is possible provided that the ICT system used by the User meets the minimum technical requirements, i.e. having the latest version of a web browser supporting Cookies and javascript and with a flash plugin installed.

III. Terms of using hdwa.pl

 

  1. The User may purchase Products offered via Hdwa.pl only after registration.
  2. New User registration is free and allows you to use the Hdwa.pl platform. In order to register, please complete the registration form available at www.hdwa.pl 
  3. The registration of a natural person who uses hdwa.pl in connection with their business or professional activity, a legal person and an organizational unit, as well as all further activities of these entities in connection with the use of Hdwa.pl, can be done by a person who is authorized to represent or incurring any obligations related to registration on their behalf 
  4. To register, complete the registration form by entering: 
    1. a. Full name (company name) of the registered entity, tax identification number, full address of the company seat together with the name of the country and region (province), name, surname and e-mail address.
  5. H2 Distribution has the right to require the User to authenticate his data.
  6. After completing the registration form, a confirmation email will be sent to the contact email address provided in the form. After confirming the Registration, the Agreement between the User and H2 Distribution is concluded, the subject of which are services provided by H2 Distribution, under the conditions set out in these regulations.
  7. The account contains all User’s data provided by him in the registration form. In the event of a change in the data specified in the Registration form, the User should immediately notify H2 Distribution by sending an appropriate statement to the e-mail address marketing@hdwa.pl.
  8. Users can have only one account
  9. The User may not use the accounts of other Users and make his account available to other persons except in the case of sharing the Account with persons duly authorized by the User to act on his behalf.
  10. The User is obliged to:
    1. Use the Hdwa.pl website in a manner consistent with the provisions of law in force in the territory of the Republic of Poland and the provisions of the regulations.
    2. Using the Hdwa.pl website in a way that does not interfere with its operation 
    3. Not using viruses or other computer codes, files or programs that may cause the malfunctioning of Hdwa.pl
  11. H2 Distribution may temporarily block a user account or terminate a contract, in particular if the User
    1. He provided false or misleading data
    2. He committed a behavior inconsistent with the regulations or applicable law.

IV. H2 Responsibility Distribution

 

  1. By accepting these regulations, the User accepts that H2 Distribution does not guarantee uninterrupted and error-free use of Hdwa.pl
  2. Limitation of liability H2 Distribution covers technical problems that may occur in the ICT system and telecommunications infrastructure, computer equipment used by the user. 
  3. H2 Distribution is not responsible for the loss of the user or entry into possession by other persons (regardless of how they come into possession) Login and Password for the User’s account.
  4. H2 Distribution reserves the right to disclose User data if the obligation to provide access to authorized bodies results from applicable law 
  5. H2 Distribution is entitled to interrupt Hdwa.pl if it is caused by:
    1. Technical or technological reasons, in particular the need to repair, modify, expand or maintain equipment or software for technical support Hdwa.pl
    2. Causes independent of H2 Distribution

V. Privacy and confidentiality

 

  1. The administrator of your personal data is H2 DYSTRYBUCJA Sp. z o. o. with headquarters in Warsaw, ul. Annopol 4A, (hereinafter referred to as “the Administrator”). The Administrator can be contacted by e-mail address: b2b@hdwa.pl, tel. (22) 751-40-44

2. Your personal data will be processed in order to implement cooperation with the entity on whose behalf you act. Your personal data will also be processed for the purpose of sending information about industry events organized by the Administrator, as well as for analytical and statistical needs related to their sending.

3. 4. Access to your personal data will be provided by employees of the Administrator, subcontractors and entities providing services to the Administrator (i.e. IT services and technical support), who must have access to data to perform their duties.

5.Your personal data will be stored for the period necessary to implement and settle this cooperation, which may, if appropriate, be extended by the limitation period for civil law claims.

6.You have the right to:

  1. request access to your personal data, rectification, deletion or limitation of processing, as well as the right to transfer data,
  2. file an objection to the processing of your personal data at any time, for reasons related to your particular situation,
  3. lodging a complaint to the supervisory body, i.e. the President of the Office for Personal Data Protection.

VI. Returns service

 

  1. Within 14 days from the date of delivery of the goods, the User may withdraw from the sales contract in whole or in part after obtaining prior consent for the return.
  2. All refund matters are processed only via the Hdwa.pl online returns system
  3. All shipments should be described as  “RETURN” and sent to the warehouse in which the product was purchased, together with the  form downloaded from the Hdwa.pl internet system. Each time after approval, the employee agrees to make a return by H2 Dystrybucja Sp. z o. o. Returns sent without the required form will not be accepted.  Please return the goods within a maximum of 7 days of accepting the return by an employee of H2 Dystrybucja Sp. z o. o.  failure to comply with the deadline specified in the form is associated with the limitation period for the return .
    4. Goods imported on special orders are not refundable (not available as standard in the offer and warehouses of H2 Dystrybucja Sp. Z o. O.
  4. Sale goods are not refundable
  5. The User may make a certain number of returns within a specified period of time, unless the reason for returning the goods is an error of an employee of H2 Dystrybucja Sp. z o. o. Exceeding the refund limit will result in a fee for each return.  The handling fee for the return, the number of possible returns and the time period is available on the hdwa.pl website in the Complaints tab. The refund fee is calculated automatically, a VAT invoice will be issued collectively once at the end of a given refund counting period.
  6. The return may only apply to full-fledged goods, without any damage or dirt or signs of use.
  7. In the case of returning goods having a unique serial number assigned by the manufacturer, it is possible to return the goods with a serial number consistent with the serial number registered on the issue / sale document.
  8. In the case of  unreported, unjustified and sent without the required returns form, the goods are sent back at the User’s expense.
  9. In the case of returns resulting from the fault of H2 Dystrybucja Sp. z o. o., goods should be sent at our expense by DPD courier (information about the customer number H2 Dystrybucja Sp. z o. o. in DPD is provided by return employees).

The Act of March 2, 2000 applies to consumer sales. on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws of 2000, No. 22, item 271, as amended).

 

VII. Final Provisions

 

  1. H2 Distribution reserves the right to change the content of these regulations and launch a new version of Hdwa.pl services
    2. The change becomes effective within the time limit indicated by H2 Distribution which cannot be less than 14 days from the time of making available the amended regulations on www.hdwa.pl .
    3. The user, when logging in to Hdwa.pl for the first time, will be notified of changes to the Regulations and the possibility of accepting the changes. Refusal to accept changes is equivalent to termination of the contract.
    4. If any of the provisions of these Regulations are found by a final court decision to be invalid, the remaining provisions shall remain in force.
    5. All possible disputes between H2 Dystrybucja and the user will be settled by a court competent for the seat of H2 Dystrybucja 
    6. In matters not covered by these regulations, the provisions of law applicable in the territory of the Republic of Poland, in particular the Civil Code, shall apply.

Cookies policy H2 Dystrybucja Sp. z o. o


1. The website does not automatically collect any information, except for information contained in cookies.

2. Cookie files (so-called “cookies”) are IT data, in particular text files, which are stored on the Website User’s end device and are intended for using the Website’s pages. Cookies usually contain the name of the website from which they originate, their storage time on the end device and a unique number.

3. The entity placing the cookies on the Website User’s end device and accessing them is the Website operator H2 Dystrybucja Sp. z o. o. with headquarters in Warsaw at 03-236 Warsaw, ul. Annopol 4A

4. Cookies are used to:
a) adapt the content of the Website pages to the User’s preferences and optimize the use of websites; in particular, these files allow to recognize the device of the Website User and properly display the website, tailored to his individual needs;
b) creating statistics that help to understand how Website Users use websites, which allows improving their structure and content;
c) maintaining the Website User’s session (after logging in), thanks to which the User does not have to re-enter the login and password on each subpage of the Website;

5. The Website uses two basic types of cookies: “session” cookies and “persistent” cookies. Session cookies are temporary files that are stored on the User’s end device until logging out, leaving the website or turning off the software (web browser). Persistent cookies are stored on the User’s end device for the time specified in the cookie parameters or until they are deleted by the User.

6. The Website uses the following types of cookies:
a) “necessary” cookies, enabling the use of services available on the Website, e.g. authentication cookies used for services that require authentication on the Website;
b) cookies used to ensure security, e.g. used to detect fraud in the field of authentication on the Website;
c) “performance” cookies, enabling the collection of information on how to use the Website’s pages;
d) “functional” cookies, enabling “remembering” the settings selected by the User and personalizing the User’s interface, eg in terms of the language or region of the User’s origin, font size, appearance of the website, etc .;
e) “advertising” cookies, enabling users to provide advertising content more tailored to their interests.

7. In many cases, the software used for browsing websites (web browser) by default allows the storage of cookies on the User’s end device. Website Users can change cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform about them every time they are placed on the Website User’s device. Detailed information about the possibilities and ways of handling cookies is available in the software (web browser) settings.

8. The Website Operator informs that restrictions on the use of cookies may affect some of the functionalities available on the Website’s pages.

9. Cookies placed on the Website User’s end device may also be used by advertisers and partners cooperating with the Website operator.
